Terms & Conditions

These Terms & Conditions apply to direct bookings, enquiries and stays arranged with LUMI•STAY through this website, email, telephone, WhatsApp or any other direct communication channel.

For reservations made through external booking platforms, such as Booking.com or Airbnb, the rules of the relevant platform also apply. If there is a conflict between these Terms and the mandatory rules of the booking platform or applicable law, those rules prevail.

2. Nature of the properties

LUMI•STAY apartments and residences are private residential homes prepared for temporary guest stays.

They are not event venues, party spaces, meeting rooms, clubs, studios or commercial premises.

The apartments are suitable for calm private stays, families, business travellers and respectful guests who accept the residential character of the building and the house rules.

3. Bookings and confirmation

A booking is confirmed only after LUMI•STAY confirms it in writing and, where applicable, receives the required payment, deposit or platform confirmation.

Prices, availability, minimum stay, cancellation rules and payment conditions may differ depending on the apartment, season, booking channel and length of stay.

For direct bookings, LUMI•STAY may request advance payment, a deposit or written confirmation of the guest details before sending final check-in instructions.

4. Registered guests only

Only guests declared in the reservation and Guest Card may enter or stay in the apartment.

The number of people in the apartment must match the number of guests confirmed in the reservation.

Visitors, additional persons, unregistered guests, parties, gatherings, meetings, celebrations, photo shoots, video shoots and commercial use are not allowed without prior written consent from LUMI•STAY.

This rule applies at all times, including short visits.

5. Guest Card and identity verification

Before check-in, the main guest may be required to complete the LUMI•STAY Guest Card.

The Guest Card confirms who is allowed to enter and stay in the apartment, helps us prepare the stay and protects guests, neighbours and the property.

LUMI•STAY does not request PESEL numbers or document scans for Warsaw stays.

The main guest may be asked to show an identity document for verification. No copy is retained for Warsaw stays.

For Croatian stays, where required by local law, guest details may be processed through the authorised visitor registration system.

Final entrance instructions may be withheld until the complete Guest Card and house rules confirmation have been received.

6. Check-in and access

Check-in instructions are sent in the booking conversation, by email or through another agreed written channel.

Guests must keep entrance instructions private and must not share them with anyone who is not included in the reservation.

Guests are responsible for using keys, codes, access cards and building entrances carefully and securely.

7. Residential use and quiet hours

The apartments are located in residential buildings or residential communities.

Guests must respect neighbours, staircases, shared spaces and quiet hours.

Quiet hours usually apply from 22:00 to 7:00, unless stricter building rules apply.

Noise, loud music, shouting, door slamming, disturbance in common areas or any behaviour that disturbs neighbours may be treated as a serious breach of house rules.

8. No parties, events or commercial use

Parties, events, gatherings, meetings, celebrations, photo shoots, video shoots, content production, commercial use and any event-like activity are not allowed without prior written consent.

If the apartment is used in breach of this rule, LUMI•STAY may terminate the stay and additional charges may apply in accordance with the booking platform rules and applicable law.

9. Care of the apartment and artworks

LUMI•STAY interiors may include original artworks, curated objects, furniture, textiles and personal design elements.

Guests must treat the apartment, artworks, equipment, keys and shared building spaces with care.

Guests must not touch, move, lean objects against, remove or damage artworks or decorative objects.

Food, drinks, luggage, cosmetics and children’s toys should be kept at a safe distance from artworks, textiles and delicate surfaces.

10. Smoking, candles and fire safety

Smoking, vaping, candles, incense, open flame and similar fire risks are not allowed inside the apartment or in shared parts of the building, unless expressly agreed in writing.

Guests must not disconnect, cover or interfere with smoke detectors, internet equipment, locks, alarms or safety-related devices.

11. Reporting problems during the stay

Guests should report any concern, fault, missing item, damage or issue without delay during the stay.

Reports should be made through the booking platform conversation or another written channel agreed with LUMI•STAY. If possible, the guest should attach photos.

LUMI•STAY must be given a reasonable opportunity to verify and resolve the issue during the stay.

If needed, the guest should allow agreed access to the apartment for inspection, repair, replacement or safety reasons.

Matters first raised after check-out may be more difficult or impossible to verify. This does not restrict any rights granted to guests by law.

12. Damage, additional cleaning and lost items

The main guest is responsible for the apartment during the stay and for the conduct of all persons who enter or stay in the apartment.

Additional charges may apply for damage, missing items, excessive cleaning, smoke smell, stains, lost keys, missing access devices, late key return, unauthorised guests or breach of house rules.

Lost, missing or late-returned keys may require lock replacement or additional security measures at the guest’s cost.

Any charges will be assessed reasonably and documented where possible.

13. Check-out

Guests must check out by the agreed check-out time unless LUMI•STAY confirms a later check-out in writing.

Before leaving, guests should:

- close windows,
- switch off lights and appliances,
- remove personal belongings,
- leave the apartment in a reasonable condition,
- return all keys exactly as instructed,
- send a short message after departure if requested.

14. Personal belongings

Guests are responsible for their personal belongings.

LUMI•STAY is not responsible for items left behind, except where responsibility cannot be excluded under applicable law.

If possible, LUMI•STAY may assist with locating and returning forgotten items. Shipping, handling or storage costs may apply.

15. Termination of stay

LUMI•STAY may terminate a stay in case of a serious breach of house rules, including but not limited to:

- unauthorised guests,
- parties or gatherings,
- disturbance of neighbours,
- refusal to stop prohibited behaviour,
- damage or safety risk,
- misuse of access instructions,
- non-return of keys or access devices.

Where the reservation was made through a booking platform, LUMI•STAY may also report the matter to the platform as guest misconduct or breach of house rules.

16. Liability

LUMI•STAY is responsible for providing the accommodation in accordance with the confirmed reservation and applicable law.

LUMI•STAY is not responsible for disruptions caused by circumstances outside its reasonable control, including building emergencies, utility failures, force majeure events, platform outages or actions of third parties, except where liability cannot be excluded under applicable law.

17. Complaints and contact

Any complaint or concern should be reported as soon as possible during the stay so that LUMI•STAY can verify and respond.

18. Applicable law

These Terms are governed by Polish law, unless mandatory consumer protection rules provide otherwise.

Nothing in these Terms limits any rights granted to guests by applicable mandatory law.
